MUNICIPAL COURT – Traffic Tickets, Disorderly Persons, and Drunk Driving- Local is Better… and Eric Schwab Knows the Territory

If you have been charged with a Motor Vehicle Violation, the offenses can range from a minor cracked windshield all the way up to serious Revoked List, Drunk/Drugged Driving Offenses and Accidents Involving Bodily Injuries. These matters are heard in the Municipal Courts. No matter what it is, Eric Schwab has done them all and can help!

Motor Vehicle offenses are contained in what is known as Title 39 of the New Jersey Statutes. Depending on the types of motor vehicle offenses charged, the penalties can include fines, court costs, loss of driving privileges and even jail in some instances. Additionally, many (though not all) moving violations generate “points” assessed separately by the NJ Motor Vehicle Commission.

Offenses (see below ) are also heard in the local Municipal Courts (there are over 500 of them in NJ!).

The serious Motor Vehicle Offense of Drunk/Drugged Driving is also heard in the Municipal Court-Mr. Schwab has handled hundreds of them in this ever-evolving area of law and is up to date on the latest Search and Seizure, Operation,Field Sobriety Tests, Alcotest and IID (Ignition Interlock Device) laws and protocols in NJ.

Although there are no guarantees, oftentimes Mr. Schwab can in many instances successfully negotiate an “alternate” resolution to most Motor Vehicle Offenses that works out well for our clients.

Finally, the Municipal Courts have jurisdiction over various Disorderly Persons Offenses as contained in Title 2C of the New Jersey Criminal Code (as well as Local Ordinance Offenses). Such “2C” offenses are what are known as quasi-criminal – but the consequences of a conviction for even a Disorderly Persons Offense can be disastrous and you should always hire your own attorney if you are charged.
